Does this address FERPA compliance for AI tools that touch student data?

How are accreditors and funders evaluating AI governance?

They are asking for documented, auditable governance, and they are testing whether the structure on paper matches one the institution actually operates. A policy that names roles without real people behind them is the weakest position, because it shows awareness of the obligation without meeting it. Anchoring the governance to a recognized framework like the NIST AI Risk Management Framework is an important starting point, and the benchmark accreditors and funders increasingly reference. It is a strong start rather than the finish. What they ultimately test is whether the authority, monitoring, and accountability the framework describes rest with named people who hold those roles in practice.

How do multi-state AI laws affect online programs?

An institution that enrolls students across many states can be exposed to the AI laws of each of them at once, which turns compliance into a multi-state operational responsibility rather than a single policy. A practical starting point is an inventory of every AI system that touches student data, student services, academic integrity, or an accreditation-sensitive process. The governance architecture is then built to hold across the strictest applicable standard, so a change in any one state does not reopen the whole question.

Does the EU AI Act reach a US institution that enrolls international students?

It can. The Act reaches providers and deployers outside the EU when an AI system's output is used in the Union, not only when the institution sits there. If an institution serves students who are located in the EU and uses AI whose output is used there, it can fall within the Act's scope, and AI used to evaluate learning outcomes, including systems that steer a student's learning path, is classified as high-risk. Enrolling international students does not trigger this by itself. The trigger is AI whose output is used in the Union. For institutions with online or global programs, this is worth mapping early rather than discovering later.
